• These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email, or by telephone. By accessing, browsing, and using our (mobile) website or any of our applications through whatever platform (hereafter collectively referred to as the “Platform”) or by completing a reservation, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below (including the privacy statement).
• You must register on our official website www.bidhaabora.com to enjoy all our facilities and services. By registering also, you agree to receive promotional emails and notifications from Bidhaabora.

 

USER SUBMISSIONS

• Anything you submit to the Site and provide to us, including but not limited to, products, services, curriculum vitae, questions, reviews, comments, and suggestions (collectively, “Submissions”) will become our sole and exclusive property and shall not be returned to you. Meaning it can be used for advertisements on our website and social media or any presentation when we are called or invited to an event.
• Bidhaabora reserves the right to use any listing/products/services/pictures of any kind on the website for advertising and marketing purposes with no legal obligation
• In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit, in connection with such review, comment, or other content.
• You shall not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.
• By completing an order or signing up, you agree to receive a) emails associated with finalizing your order, which may contain relevant offers from third parties, b) emails asking you to review Bidhaabora and your purchase, and c) promotional emails, WhatsApp, Telegram, SMS and push notifications from Bidhaabora. You may unsubscribe from promotional emails via a link provided in each email. If you would like us to remove your personal information from our database, and unsubscribe from emails and/or SMS, please email the Customer Service email address by country.

PAYMENTS TERMS

• Payments are made when placing an order to our official website or office premises. Payments are made in full, no installments are allowed, and an official receipt is obtained either via email, WhatsApp, or physically.
• Payment shall be made in cash, Empesa pay bill, Till number, Credit/debit cards, PayPal, Skrill, cheques, or bank transfer and in any currencies of the world.
• Bidhaa Bora receives a 2% commission on every purchase of any products, services, or jobs earned on our website
• All purchases are paid to Bidhaa Bora and Bidhaa Bora pays the sellers, and service providers within a period of 7-14 days.
• Payments to vendors, service providers, or stakeholders shall be by Mpesa or bank transfer

 

DELIVERY TERMS

• Bidhaa Bora will deliver products sold on our website at a delivery cost depending on the location, size of the product, and weight of the product.
• Bidhaa Bora can repackage any products using their own branded colors if they so wish to do so.
• Goods shall be delivered within 10 days minimum upon placing an order and 21 days maximum
• Overseas Products may take up to 40 days to be delivered depending on the mode of shipment.
• A delivery note shall be sent either via email or presented by hand together with the products upon delivery
• Bidhaa Bora reserves the right to postpone delivery in case of force majeure for the duration of the obstruction plus a reasonable period of recuperation. Strikes, unforeseeable events, or interruptions of operations are considered force majeure, should we not influence these events and deliveries have become impossible by an act beyond our control we reserve the right to partially or completely rescind the contract.
• A communication protocol between us and our clients shall be established in the process of delivery. Communication can be via email, text message, or WhatsApp message
• The customer shall establish communication regarding the return of items with Bidhaa Bora.

 

SELLING ON BIDHAABORA AND SERVICES CATEGORIES

SELLERS AND USERS SHOWCASING SERVICES.

• Selling and showcasing your products and services on our website operates as an online retail portal for buyers, sellers, consumers, and community members.
• Anti-Christian, Pornographic, or satanism products, services, or items are strictly forbidden to be listed on the website
• Sellers of products and services are allowed to list their high-quality and affordable products & services here and we showcase and advertise them all over the world. Bidhaabora shall be paid 2% value of each product sold by each seller.
• Bidhaabora Limited can also list products and services of its own if it wishes to.
• Bidhaabora reserves the right to use any listing/items/pictures of any kind on the website, newsletters, social media pages, or billboards for advertising and marketing purposes with no legal obligation
• Sellers are mandated to sell high-quality products and offer high standards of services at affordable prices. listing products on the website is free and listing services is ksh 50 per month per service with an option to renew the monthly lease
• You must provide accurate information to Bidhaabora and our customers and update the information if it changes. For example, this means that you must use a business name that accurately identifies your business, Address, and Contact details and list your products in the correct category.
• Bidhaabora may offer Warehouse, store, ship, or deliver at an extra charge of the consumers however sellers may also deliver products to the customer by themselves to promote their brand independently-In this case, an agreement between the seller, consumer shall be reached in their terms. Bidhaa Bora will not have any legal obligation in this scenario or be held responsible of any fraud or inconveniences from the seller or buyer.
• All payments will be made to Bidhaabora accounts then Bidhaabora will transfer the payments to sellers/users once the products have been delivered. Bidhaabora shall be paid 2% value of each product sold by each seller. And ksh 50 monthly per each service listed.
• Sellers and service providers shall not obtain clients within our clientele list or come up with an agreement outside the website with a client. All transactions shall be completed on our official website or office premises. Sellers/Vendors risk being burned for life from using the website if found stealing buyers from the website and making their arrangements outside the website or our office premises
• No seller/Vendor or service provider is a representative of Bidhaabora unless they have a company ID. Sellers shall not present themselves as employers of Bidhaabora
• All items and services listed by sellers shall be the responsibility of sellers and service providers themselves and they are answerable to the laws of the land in case a dispute arises, or the product/service is subjected to police investigations. Bidhaabora is obligated to give all necessary support and information to the law enforcers when they are called upon to do so
• Bidhaabora may vet products and make the final call on items to be listed on their website. They can also remove products and services from the listings with no explanation if they feel it’s not appropriate
• Bidhaa Bora may collect products from vendors/sellers and deliver them to customers who placed orders on the website or mobile Application at a delivery fee payable by the customer
• Bidhaa Bora reserves the right to repackage any products with their colors and branding if they wish to do so

BUYERS/USERS IN GENERAL

• Bidhaa Bora delivers most if not all products sold on their website at a delivery charge payable by the customers who placed orders on the website. Bidhaa Bora can also repackage any products with their colors and branding
• Bidhaabora is not responsible for, nor holds itself out as promoting, any interaction or dealing between you and 1 or more other users (s) of the Website outside the set rules of engagement, and Bidhaabora will not be liable in any way for any such interactions or dealings outside our framework.
• You will not hold Bidhaabora responsible for other users’ Content, actions, inactions, items, and services they list, or the destruction of allegedly stolen, fake items or services.
• We have no control over and do not guarantee the quality, safety, or legality of items and services advertised, the truth or accuracy of users’ Content or listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will complete a transaction or return an item. For certain categories, particularly motor vehicles and real estate, an offer initiates a transaction representing a buyer’s serious expression of interest in buying the seller’s item and does not create a formal contract between the buyer and the seller.
• You acknowledge that Bidhaabora does not monitor, verify, or approve sellers, service providers, or Content and that you are solely responsible for evaluating and verifying the accuracy of any Content posted on the Website.
• Buyers use our website at their own will, and they are not mandated or obligated to use our services unless when convinced by themselves to do so. It’s the free will of an individual to use our website and services/classifieds being showcased
• Both parties agree that browsing the website and gathering information regarding the services provided by the seller does not constitute an offer to sell, but merely an invitation to treat. The parties accept that an offer is only made once you have selected the item you intend to purchase, chosen your preferred payment method, proceeded to the checkout, and completed the checkout process.
• Both parties agree that the acceptance of the offer is not made when the seller contacts you by phone or by email to confirm that the order has been placed online. Your offer is only accepted when we dispatch the product to you and inform you either by email or by phone of the dispatch of your ordered product.
• Before your order is confirmed, you may be asked to provide additional verifications or information, including but not limited to phone number and address, before we accept the order.
• Please note that there are cases when an order cannot be processed for various reasons. The Site reserves the right to refuse or cancel any order for any reason at any given time.

 

PRODUCT RETURN POLICY

• Products can be returned within THREE days if it is damaged or not working but not because it did not meet your expectations
• Application of return products must be within 24HRS after the time you received the product
• Application of returning products should be on our website or mobile application only
• Product must be in its original package without any damaged box or its packaging unit

 

USE OF BIDHAABORA VOUCHER

• Our Site accepts the use of our vouchers acquired through the lottery, promotions, or refund process.
• The marketing voucher codes that are accepted on our Site entitle you at the time of ordering a product to a saving on the order being placed on our Site.
• Vouchers may also be issued to customers in exchange for advance payments made to us via transfer to our bank accounts for products intended to be purchased on the Site.
• Our voucher codes may not be exchanged for cash. Except for vouchers issued by our refund policy and vouchers issued in exchange for advance payments, we reserve the right to cancel or withdraw our voucher codes at any time.

 

TERMINATING OF ACCESS

• Bidhaabora reserves the right to block you or terminate you from accessing the Website for any breach of these Terms of Use at any time without any notice.
• Bidhaabora reserves the right to delete any of your Content from the Website at any time.
• Bidhaabora is not liable to you or a third party for any termination of your access to the Website or deletion of your posted Content.

Bidhaabora African Pride showcases only African products built and processed only in Africa by African companies.
• All products listed in this category shall be purely African, made in Africa, and by Africans.
• Bidhaabora showcases African products all over the world through our website and marketers
• Any item that is not made in Africa or its brand is not considered African shall be removed from the category
• Listing products in this category is free for sellers however a commission of 2% is charged for every product sold on our site.
• All payments will be made to Bidhaabora accounts then Bidhaabora will transfer the payments to sellers/users once the products have been delivered
• All items and services listed by sellers shall be the responsibility of sellers and service providers themselves and they are answerable to the laws of the land in case a dispute arises, or the product/service is subjected to police investigations. Bidhaabora is obligated to give all necessary support and information to the law enforcers when they are called upon to do so
• Bidhaabora may offer Warehouse, store, ship, or deliver at an extra charge payable by customers/consumers and not sellers however sellers can also deliver products to the customers to promote their brand independently
• Bidhaa Bora will collect items from vendors’ shops or stores and deliver them to customers. The shipping/delivery charge shall be paid by the customer and not the vendors.
• Bidhaa Bora can repackage the items with their colors or branding if they wish to do so

 

BIDHAA BORA JOBS TERMS AND CONDITIONS

This category offers options for job seekers to store their resumes with us for one month at a cost of Ksh 50.
Employers come and peruse through the stored resumes and pick their best potential employees. Both job seekers and employers shall observe the following terms and conditions.

JOB SEEKERS

• The resume/ insertion or information/data fed by the user can be updated by the user alone.
• Bidhaabora shall not be responsible for any changes made to the resume/information uploaded by the user.
• Bidhaabora offers neither guarantee nor warranties that there would be a satisfactory response or any response at all once the resume/insertion or information/data is fed by the user.
• Bidhaabora neither guarantees nor offers any warranty about the credential’s bonfires, status, or otherwise of the prospective employer/organization which downloads the resume/ insertion or information/data and uses it to contact the user.
• Bidhaabora would not be held liable for loss of any data technical or otherwise, or of the resume/ insertion or information/data or particulars supplied by the user due to acts of nature as well as reasons beyond its control like corruption of data or delay or failure to perform as a result of any cause(s) or conditions that are beyond our reasonable control including but not limited to strikes, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, distributed denial of service attacks, virus attacks, war and natural calamities.
• Bidhaabora allows recruiters to download resumes of jobseekers for future consideration without the jobseeker’s prior consent and preferences. We shall not be held responsible for any dissemination of information including uploaded photographs outside its purview.

EMPLOYERS

• Employers are allowed to list their vacancies as many times as possible all for free
• Employers are allowed up to three potential picks in our resume banks for a potential interview. Any additional picks after three are chargeable at a cost of Ksh 500 per pick.
• Bidhaabora allows recruiters to download the resume of jobseekers for future consideration without the jobseeker’s prior consent and preferences. We shall not be held responsible for any dissemination of information including uploaded photographs outside its purview.
• Bidhaabora will not be liable for the accuracy and legit information of users’ resumes and qualifications.
• Bidhaabora does not present or recommend any candidates to any employers. All employers getting their candidates from Bidhaabora are responsible for the candidates they choose and scrutinizing their credentials and qualifications. We shall not be held responsible in case of fake qualification credentials or paperwork such as visas or work permits.
• Bidhaabora is not responsible for any contracts signed between candidates and employers in any way- candidates selected from our sites by various employers are responsible for viewing the contracts provided to them and Bidhaabora is not liable for any breach of contract between employers and candidates selected from our site.

 

BIDHAA BORA TRAVEL

The Bidhaabora travel category of our website operates the section as an online advertising portal for Hotels, Cars, Cruises, Flights, and Tours across the world for free. We do not have any of our services directly in the category and we are never a party to any transaction between users and service providers. As a result, Bidhaabora does not:
• Guarantee safety or give general guarantees of all services listed in these categories. Each company that has listed its services with us offers a guarantee to their clients as per their terms and conditions
• Collect or process payment or transfer of title on behalf. All payments shall be made directly to the service provider selected by the clients. Bidhaabora collects a commission of 10% of the total revenue spent by clients/users from our website.
• Bidhaabora is not responsible for, nor holds itself out as promoting, any interaction or dealing between you and 1 or more other user(s) of the Website, and Bidhaabora will not be liable in any way for any such interactions or dealings.
• You will not hold Bidhaa Bora responsible for other users’ Content, actions, inactions, or product quality they list. We are not obliged to participate in any dispute between you and the listed product or service provided ‘
• We have no control over and do not guarantee the quality, safety, or legality of places, cars, tours, cruises, or flight deals advertised, the truth or accuracy of users’ Content or listings, the ability of sellers to sell, the ability of buyers to pay, or that a buyer or seller will complete a transaction.
• You acknowledge that Bidhaabora does not monitor, verify, or approve Content and that you are solely responsible for evaluating and verifying the accuracy of any Content posted on the Website.
• Unless indicated otherwise, our service is free of charge for consumers because, unlike many other parties, we will not charge you for our Trip Service or add any additional (reservation) fees to the rate. You will pay the Trip Provider the relevant amount as indicated in the Trip Reservation (plus – insofar not included in the price – relevant applicable taxes, levies, and fees (if applicable)).

• Bidhaabora Foundation also supports underprivileged children across the world. We support Hospitals for children and sponsor them in schools by providing computers and scholarships.
• We offer bursaries for bright kids and support their education. We offer books to poor schools in Africa and all over the world
• We visit children’s homes and play with them, encourage them, and pray with them
• We respond to any needs of the society when called upon at any time
• We volunteer in any life-changing courses, we are always ready and available to join any collaborators in changing this world through invitations
• When invited to any occasion, we reserve the right to deny the invitation but if in attendance, we are obligated to ask for pictures or videos that can be used on our website or social media as a testimony of our attendance and goodwill in giving back to our communities.

You can help support our course either by being a partner, or stakeholder or by donating your contribution to the Bidhaa Bora Foundation. The below agreement shall be consented to by the stakeholders and as well those who have been honored to receive our generosity campaigns and donations

• Stakeholders, sponsors, and donors shall reserve the right to advertise on our website for the agreed period between Bidhaabora and them.
• Bidhaa Bora shall provide every account of all donations, and it will be sent to the relevant parties in detail via emails and statements
• Donors and well-wishers may wish to select and sponsor an individual child in their comfort. We will assist and support all the well-wishers in improving the life of the selected child or youth
• Donations will be made at the comfort of the donor. We will listen and follow their wishes.
• Bidhaa Bora Foundation will use any photos or videos on our website or social media pages to showcase our humanitarian and good Samaritan campaigns
• Any donations, Products, properties, or any other items or services offered to communities and the world will never be claimed back by the Bidhaa Bora Foundation

 

UNHAPPY CUSTOMER OR VENDOR OR WEBSITE/MOBILE APPLICATION USER

• All users of the website claiming not to be satisfied with our organization or business practices are required to contact us first through our official email address, info@bidhaabora.com, so we can address their concerns before proceeding elsewhere.
• Bidhaa Bora will not listen to any complaints that have been raised outside, and it was never brought to their attention
• Customers are invited to give feedback and suggestions for us to improve and be better
